Man Found Not Guilty of Sexual Misconduct with Six Year Old

CIRCLEVILLE – On June 18, 2019, a jury found a Circleville man not guilty of rape, a felony of the first degree. The trial, held before Judge P. Randall Knece in Pickaway County Common Pleas Court, began on June 17 and lasted for two days. 

Roger W. Moss had been accused of engaging in sexual conduct with a six year old female child.  The incident allegedly occurred on Kime Holderman Road in July of 2018.

The State of Ohio was represented by Assistant Prosecuting Attorney Heather M.J. Carter. Ms. Carter called seven witnesses to testify, including the person from Nationwide Children’s Hospital who interviewed the child following the incident. While the child herself did not testify, a tape of the child’s interview at Nationwide Children’s Hospital was played for the jury.



Also testifying for the prosecution were a detective who interviewed Mr. Moss, the mother of the child, the grandmother of the child, and the forensic DNA scientist who conducted lab tests at Ohio BCI. 

Mr. Moss was represented by local attorney Matthew O’Leary. Mr. O’Leary called two witnesses. His first witness was an Assistant Laboratory Director for a private DNA testing laboratory.  The second witness was one of the detectives who had interviewed Mr. Moss after the accusation had been made.  

The jury deliberated for approximately two and a half hours before rendering a not guilty verdict.
