Columbus City Attorney Will No Longer Prosecute for Misdemeanor Marijuana Possession

COLUMBUS – Zack Klein says that he will no longer prosecute misdemeanor marijuana possession. This comes after a City Council vote to lower penalties of small amounts of marijuana possession.

“Following the recent hemp legislation passed by the State Legislature and signed by the Governor, the Columbus City Attorney’s office will no longer be prosecuting misdemeanor marijuana possession cases, and we are dismissing any current pending misdemeanor marijuana possession charges,” said Klein.

With the new policy the City Attorney will be dismissing all marijuana charges that apply, they will not dismiss other charges unless they have a distinct reason to do so.

Possession is still illegal and it is legal to stop and seach someone with reasonable suspicion or probable cause they are in possession.

OVI on a marijuana intoxication will be reviewed on a case by case and may not dismiss on this basis.

This is effective immediately per Klein.
