Ohio Highway Patrol Seize 55 Gallons of CBD Hemp Oil

COLUMBUS – Ohio State Highway Patrol troopers filed felony drug charges against two Rhode Island men after a traffic stop in Muskingum County. During the traffic stop, troopers seized 7,040 liquid ounces of CBD oil worth approximately $165,000.

On February 25, at 12:04 p.m., troopers stopped a 2017 U-Haul truck with Arizona registration for a marked lanes violation on Interstate 70. Criminal indicators were observed and a Patrol drug-sniffing canine alerted to the vehicle. A probable cause search revealed the contraband. As per other sources CBD Oil made from Hemp which do not typically have the psycoactive drug THC.

The driver, Joshua Sellers, 37, of Providence, R.I, and passenger, Richard Defedele, 37, of North Kingston, R.I., were charged with possession of a schedule 1 substance, a first-degree felony.

If convicted, each one of them could face up to 11 years in prison and up to a $20,000 fine.

According to State Highway Patrol CBD oil made from strains of cannabis that contain low levels of THC.

In 2018, the Senate introduced a new Farm Bill to update laws around the previous one. One important part of that bill, should it pass, is that it would legalize hemp on a federal level.

 Hemp being federally legal would be huge for the CBD industry, as CBD oil made from hemp extract (a plant that has very low amounts of THC) would be legal. A new, more available form of CBD would also allow for more research on the subject of cannabidiol, and perhaps the entire marijuana plant. More research brings the potential of coming closer to full legalization.

    • Each state has its own regs as far as CBD. Right after the farm bill passed 4 states said theu would not honor it. Idaho still requires 0%thc even though the farm bill allows 3%. The FDA also came out right after the farm bill passed and said CBD is still a schedule 1 drug (but opioids are not) and some producers have had their CBD packages seized by the post office. Not truly legal yet in all 50 states. It is really hard cause I have a whole flower fluid that is superior to any oil nit Idaho still wont let me sell it here.

  1. That’s why it is a good idea to know your state laws. Even though the Farm Bill has been signed, lawmakers know a state level are confused. All because the DEA/FDA are taking so long to get on board. Yes, it is legal to grow, and process (with licensing), however state line commerce is directly, and negatively effected due to the fact that it is STILL a schedule 1 drug.

  2. The farm bill passed in December so hemp IS LEGAL on a federal level. When they take this case to federal court they will lose and it will be even more embarrassing for Ohio. The farm bill states it can legally be consume and purchased through E-commerce in all 50 states. The Ohio Pharmacy board needs to revoke their statement as it contradicts the WHO statement that Hemp is a DIFFERENT plant than marijuana and in fact has no psychoactive effects.

    • It has to come from a licensed grower of hemp though. There is virtually no chance that this was from a licensed grower. If the prosecutor doesn’t throw this case out, the people need to throw him out at the next election.

  4. They have to homer the new law passed. The Farm Bill of 2018 has legalized hemp CBD in all 50 states. Any state can say they aren’t going to honor it but when it comes down to it and it goes to court they won’t have a leg to stand on. The FARM BILL THAT LEGALIZED IT SIGNED BY TRUMP IS A FEDERAL LAW!!! FEDERAL OVER RIDES STATE LAW….So they can try and make up their own state laws…but it won’t matter!!!
